Registering a Trademark in Thailand

Limited Protection for Foreign Trademarks

Thai law generally recognizes foreign trademarks but offers limited protection. Thailand is not strictly bound by international conventions or treaties for reciprocal trademark enforcement. Registering a Thai trademark is the only way to ensure full protection of your rights. Although the process can be lengthy, the trademark is protected from the date the application is submitted.

Requirements for Trademark Registration

An applicant for a trademark must have a fixed place of business in Thailand. Non-resident applicants can only register a trademark by appointing a Thai resident agent and granting them power of attorney. Trademark applications must be completed in Thai.

Required Documents:

  • A logo of the trademark in the exact color.
  • A copy of the company affidavit of the applicant (if based abroad) and an original set of the company affidavit if the applicant is a Thai company.
  • Signed passport copy of the authorized director(s).
  • A signed power of attorney (notarized if signed from abroad).

Trademark Registration Process:

  • Perform a trademark search to ensure no similar mark is already registered.
  • Submit the application and provide necessary explanations or statements to the Trademark Registrar as requested.
  • File the official form with the Department of Intellectual Property, including a sample of the product and the applicant’s address in Thailand.
  • The application will be published in the Trademark Gazette for 90 days. If no objections are filed, the trademark will be registered, and the registration fee will be due.
Thailand Trademark Classes

Thailand follows the 10th edition of the Nice Classification system with 34 classifications for goods and 8 classifications for services. Separate applications are required for each classification if a trademark is intended for more than one class.
